NHTSA Opens Safety Audit Into Nearly 1,000 Tesla Cybercabs Following Commercial Launch

The National Highway Traffic Safety Administration has opened an audit into about 1,000 Tesla Cybercabs, examining the EV maker's safety certification process one day after the vehicle's commercial launch in Austin, Texas.

The U.S. National Highway Traffic Safety Administration has opened an audit into approximately 1,000 Tesla Cybercab vehicles, examining the technical data and certification process the electric vehicle maker relied on to claim compliance with federal safety standards.

The probe was announced Friday, one day after Tesla began commercial deployment of a small number of the two-seater autonomous vehicle in Austin, Texas, with plans to gradually expand the service to additional vehicles and locations.

At the center of NHTSA's inquiry is the Cybercab's lack of permanently attached conventional manual controls — including a steering wheel, brake pedal, accelerator pedal, and mirrors. The agency said it would examine the basis for Tesla's safety certification and related issues, including the extent to which the company determined that certain Federal Motor Vehicle Safety Standards did not apply to the vehicle.

Tesla did not immediately respond to a request for comment.

As of Friday morning, Tesla had 420 autonomous vehicles registered in Texas under state records, including 45 Cybercab vehicles — underscoring how early the commercial rollout remains, even as NHTSA's scrutiny begins.

The audit reflects the regulatory complexity facing fully autonomous vehicles that are designed from the outset without traditional driver controls. Federal Motor Vehicle Safety Standards were written with human operators in mind, and manufacturers seeking to deploy vehicles that fall outside those assumptions must navigate a legal and technical landscape that has not yet been formally updated to accommodate them.

Tesla's approach — certifying the Cybercab as compliant while arguing that certain standards do not apply — is precisely the kind of determination NHTSA indicated it intends to probe. The agency's review could have broader implications for how other autonomous vehicle developers certify their own purpose-built robotaxi platforms.

The Cybercab launch in Austin marks one of the most closely watched moments in consumer autonomous vehicle deployment to date, coming as several companies compete to establish commercial robotaxi operations in major U.S. cities. NHTSA's decision to open a formal audit so rapidly after the first commercial trips signals that federal regulators intend to scrutinize self-certification claims closely, even as the administration has broadly signaled openness to autonomous vehicle expansion.
